These Terms & Conditions (“Terms of Use” or “Terms”) are a legally binding agreement between you (“you,” “your,” or “User”) and Plantation Boat Mart & Marina, Inc. (“Plantation Boat Mart,” “Company,” “we,” “us,” or “our”) governing your access to and use of our website and any related pages, forms, communications, and online services (collectively, the “Site”).
By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.
We may post additional guidelines, policies, or rules on the Site from time to time (including, for example, policies related to scheduling, payments, promotions, or slip/storage rules). Any such materials are incorporated by reference into these Terms.

By using the Site, you represent and warrant that:
You are at least 18 years old (or the age of majority in your jurisdiction) and have legal capacity to enter into these Terms.
You will use the Site only for lawful purposes.
You will not use automated means (bots, scrapers, scripts) to access the Site without our written permission.
Any information you submit is accurate, current, and complete.
We may suspend or terminate access if we believe information you provided is inaccurate or if you violate these Terms.

Any boating, marine, mechanical, safety, pricing, availability, specifications, or service information is not a guarantee and should not be relied upon as the sole basis for decisions. You are responsible for verifying information directly with us before purchase, scheduling, launching, or operating a vessel.
Unless otherwise stated, the Site and all content on it—including text, images, graphics, videos, logos, designs, software, and selection/arrangement (“Content”)—are owned by or licensed to Plantation Boat Mart and protected by intellectual property laws.
You may view, download, or print Content for personal, non-commercial use only. You may not copy, reproduce, modify, distribute, publish, display, or exploit any Content for commercial purposes without our prior written consent.
If the Site provides account functionality, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately if you suspect unauthorized access. We may disable or terminate accounts at any time.

The Site may include vessel listings (new and pre-owned), parts, accessories, service packages, promotions, slip/storage information, or other offerings.

All listings, pricing, promotions, trade-in estimates, and availability are subject to change without notice.
Photographs may be representative and may show optional equipment not included in a listed price.
Specifications, hours, condition, features, and descriptions may contain errors or omissions and are not guaranteed.
Pre-owned vessels are sold subject to prior sale, and “as-is” terms may apply as described below.
You agree to verify all material details (including price, taxes, fees, condition, included equipment, and availability) directly with us before relying on them.
Any quote, estimate, or range provided via the Site, email, phone, or text is non-binding unless expressly stated in a signed written agreement. Quotes may exclude taxes, title/registration, freight, prep, rigging, diagnostics, shop supplies, environmental fees, disposal fees, storage/yard fees, marina fees, and other charges unless specifically included.
Service estimates can change after inspection, diagnostic work, tear-down, discovery of hidden damage, prior poor repairs, corrosion, or parts availability issues. We will attempt to contact you for authorization of material changes when reasonably practicable.
If you request appointments, service, surveys, haul-outs, launches, sea trials, training, or deliveries:
Appointment times are not guaranteed until confirmed by us.
We may require deposits to reserve inventory, schedule service, order parts, or reserve marina/yard resources.
Deposits may be non-refundable in certain circumstances (including special orders, reserved haul-outs, missed appointments, or cancellations outside a stated window). Any non-refundable terms will be disclosed at the time of deposit.
We reserve the right to reschedule due to weather, tides, safety, staffing, equipment availability, emergencies, or other operational constraints.
If you purchase products or services:
You agree to provide accurate billing and payment information.
All sales are subject to applicable taxes and fees.
Financing (if offered) is subject to lender approval and separate lender terms. We do not guarantee approval, rates, or terms.
We may refuse or cancel orders in our discretion, including due to suspected fraud, pricing errors, inventory issues, or payment problems.
Unless required by law or otherwise stated in writing:
Special-order items may be non-returnable.
Returned items may be subject to restocking fees and must be unused and in original packaging.
Labor charges, diagnostic fees, and time-based services are generally non-refundable once performed.
12. “AS IS” and Warranty Disclaimers
To the fullest extent permitted by law:
The Site and its Content are provided “AS IS” and “AS AVAILABLE.”
We disclaim all warranties regarding the Site, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Vessel/Equipment Warranties:
Manufacturer warranties (if any) are provided by the manufacturer and may be subject to separate terms, registration, maintenance requirements, and exclusions. For pre-owned vessels, warranties may be limited or unavailable unless explicitly provided in writing.
Pre-Owned/Used Vessels:
Unless expressly stated in a signed written agreement, pre-owned vessels and trailers may be sold AS IS, WHERE IS, WITH ALL FAULTS, with no warranties, express or implied, except where prohibited by law.
When you authorize service, you authorize us (and our employees/contractors) to operate your vessel and related equipment as reasonably necessary for diagnostics, testing, moving/relocating on property, and sea trials (when applicable and authorized).
You are responsible for:
Removing personal items and securing valuables.
Disclosing known issues, hazards, modifications, and installed electronics/accessories.
Ensuring you have adequate insurance coverage.
Storage & Yard/Slip Fees:
If your vessel remains on our premises before or after service, you may be charged storage/yard/slip fees as posted or communicated.
Unpaid Balances / Abandoned Vessels:
If permitted by law, we may assert a lien, restrict release of the vessel until payment is made, and/or pursue legal remedies for unpaid charges, including storage fees and costs of collection.
14. Marina and Premises Rules (Safety and Conduct)
If you visit our premises, marina, docks, or yard, you agree to follow posted rules and all staff instructions, including safety and environmental requirements. You agree not to:
Engage in unsafe behavior, harassment, or disorderly conduct
Bring hazardous materials without approval
Perform hot work (welding/grinding) without written authorization
Discharge pollutants, fuels, oils, sewage, or trash improperly
We may refuse service or require you to leave the premises for safety or operational reasons.
The Site may include links to third-party websites or tools (e.g., map providers, manufacturers, lenders, review sites, social media). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.
If you submit inquiries, forms, reviews, feedback, photos, videos, or other materials (“Submissions”), you agree that:
Submissions are not confidential (unless we state otherwise in writing).
You grant us a worldwide, royalty-free, perpetual license to use, reproduce, and display Submissions for lawful business purposes (e.g., responding to you, improving services, marketing), subject to applicable law.
You represent you have the rights to submit the content and it does not violate third-party rights.
If you provide your phone number and opt in to receive calls or texts, you consent to receive communications from us regarding scheduling, estimates, service updates, order status, marketing (if separately opted-in), and customer support. Message and data rates may apply; message frequency varies. You can opt out of promotional texts by replying STOP (where applicable).
Calls may be recorded or monitored for quality assurance and training where permitted by law. If recording occurs, we will provide notice as required.
We may, in our discretion and without liability:
Monitor the Site for violations of these Terms.
Restrict, suspend, or terminate access to the Site.
Remove content or disable features.
Take legal action if necessary.
These Terms remain in effect while you use the Site. Sections that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive termination.
Boating and marina activities carry inherent risks, including serious injury, property damage, or death. You assume all risks associated with operating, boarding, launching, docking, fueling, trailering, or being near marine environments, including risks related to weather, tides, wakes, marine life, slippery surfaces, and equipment failure.
To the fullest extent permitted by law, in no event will Plantation Boat Mart or its owners, officers, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, loss of use, or business interruption, arising out of or related to your use of the Site or any reliance on Site content.
To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid to us (if any) for the specific product or service giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Plantation Boat Mart and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:
Your use of the Site
Your violation of these Terms
Your violation of laws or third-party rights
Your Submissions
Your misuse or operation of any vessel/equipment in connection with our services
These Terms and your use of the Site are governed by the laws of the State of Florida, without regard to conflict of law principles.
Informal Resolution: Before initiating arbitration or litigation, you agree to contact us and attempt to resolve the dispute informally.
Binding Arbitration: If informal resolution fails, any dispute arising from or relating to these Terms or the Site will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under applicable rules, except where prohibited by law.
Arbitration Location: Unless otherwise required, arbitration will take place in Monroe County, Florida (or another Florida county we agree to in writing). Arbitration may be conducted by documents, phone, or video when allowed by the AAA rules.
Class Action Waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Exceptions: Either party may seek injunctive relief in court for intellectual property misuse, unauthorized access, or security-related harm.
If any portion of this arbitration section is found unenforceable, the remainder will remain in effect to the fullest extent permitted.
We may correct errors, inaccuracies, or omissions on the Site at any time without notice. We do not guarantee the Site will be uninterrupted, secure, or error-free. We may suspend or discontinue the Site (in whole or in part) at any time.
By using the Site and communicating with us electronically, you consent to receive communications electronically and agree that electronic records, signatures, and notices satisfy legal writing requirements to the extent permitted by law.
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain valid. Our failure to enforce a provision is not a waiver. We may assign our rights and obligations under these Terms. These Terms, plus any policies posted on the Site, constitute the entire agreement regarding Site use.
